Los Servicios son prestados por Apollo Net LLC en nombre de Kramden Institute. Al suscribirse, acceder o utilizar nuestros Servicios, usted reconoce que ha le\u00eddo, comprendido y acepta quedar vinculado por estos T\u00e9rminos.  <\/span><\/p><h2><b>1. Definiciones<\/b><\/h2><p><b>\u201cServicio\u201d<\/b><span style=\"font-weight: 400;\"> se refiere al servicio de internet de banda ancha inal\u00e1mbrica prestado por Apollo Net LLC, incluidas todas las funciones, funcionalidades y servicios de asistencia asociados.<\/span><\/p><p><b>\u201cEquipo\u201d<\/b><span style=\"font-weight: 400;\"> se refiere a cualquier m\u00f3dem, router u otros dispositivos de hardware proporcionados por Apollo Net LLC para su uso con el Servicio.<\/span><\/p><p><b>\u201cOperador de red\u201d<\/b><span style=\"font-weight: 400;\"> significa T-Mobile US Inc., sus filiales y empresas asociadas cuya infraestructura de red se utiliza para prestar el Servicio.<\/span><\/p><p><b>\u201cMVNO\u201d<\/b><span style=\"font-weight: 400;\"> o <\/span><b>\u201cMission Telecom\u201d<\/b><span style=\"font-weight: 400;\"> significa Mission Telecom, el Operador M\u00f3vil Virtual (MVNO) que presta servicio mayorista a Kramden Institute a trav\u00e9s de Apollo Net LLC en virtud de su acuerdo con T-Mobile.<\/span><\/p><p><b>\u201cSuscripci\u00f3n\u201d<\/b><span style=\"font-weight: 400;\"> se refiere a su plan de servicio mensual con Apollo Net LLC.<\/span><\/p><p><b>\u201cFecha de entrada en vigor\u201d<\/b><span style=\"font-weight: 400;\"> significa la fecha en la que usted se suscribe por primera vez para utilizar el Servicio.<\/span><\/p><h2><b>2. Descripci\u00f3n del servicio<\/b><\/h2><h3><b>2.1 Oferta del servicio<\/b><\/h3><p><span style=\"font-weight: 400;\">Este acuerdo se celebra entre el Cliente y Kramden Institute para la prestaci\u00f3n del servicio de internet de banda ancha inal\u00e1mbrica. Kramden Institute presta este Servicio a trav\u00e9s de Apollo Net LLC en colaboraci\u00f3n con Mission Telecom, utilizando la infraestructura de red de T-Mobile. El Servicio se ofrece mes a mes por 35 $ al mes o por 30 $ al mes si se paga por adelantado el a\u00f1o completo.  <\/span><\/p><h3><b>2.2 Disponibilidad del servicio<\/b><\/h3><p><span style=\"font-weight: 400;\">El servicio est\u00e1 sujeto a la disponibilidad en su zona, as\u00ed como a posibles limitaciones t\u00e9cnicas. La disponibilidad, calidad, velocidad y fiabilidad del servicio pueden variar en funci\u00f3n de: <\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Su ubicaci\u00f3n y distancia a las torres de red<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Capacidad de la red y congesti\u00f3n<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Condiciones meteorol\u00f3gicas<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Funcionamiento del equipo<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Materiales de construcci\u00f3n e interferencias estructurales<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Actividades de mantenimiento<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Otros factores fuera de nuestro control<\/span><\/li><\/ul><h3><b>2.3 Sin garant\u00eda de servicio<\/b><\/h3><p><b>APOLLO NET LLC NO ES PROPIETARIA, NI OPERA, NI CONTROLA LA INFRAESTRUCTURA DE RED SUBYACENTE. SOMOS UN REVENDEDOR DE SERVICIOS PRESTADOS POR MISSION TELECOM, QUE A SU VEZ OBTIENE EL SERVICIO DE T-MOBILE. POR LO TANTO, NO PODEMOS NI GARANTIZAMOS:  <\/b><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Un Servicio ininterrumpido o sin errores<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Velocidades o ancho de banda espec\u00edficos<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Disponibilidad en todas las ubicaciones<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Compatibilidad con todos los dispositivos o aplicaciones<\/span><\/li><\/ul><h2><b>3. Equipo<\/b><\/h2><h3><b>3.1 Suministro de equipo<\/b><\/h3><p><span style=\"font-weight: 400;\">Apollo Net LLC proporcionar\u00e1 el equipo necesario sin coste alguno; dicho equipo puede ser nuevo, usado o reacondicionado. Tras su recepci\u00f3n, el Equipo seguir\u00e1 siendo propiedad de Apollo Net LLC hasta el aniversario de un a\u00f1o de la suscripci\u00f3n, momento en el cual pasar\u00e1 a ser propiedad del suscriptor. <\/span><\/p><h3><b>3.2 Restricciones del equipo<\/b><\/h3><p><span style=\"font-weight: 400;\">Usted acepta:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">No manipular, modificar, aplicar ingenier\u00eda inversa ni alterar el Equipo<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Utilizar con el Servicio \u00fanicamente el Equipo proporcionado por Apollo Net LLC<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">No utilizar equipos de terceros salvo autorizaci\u00f3n expresa por escrito<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Mantener el Equipo en buen estado de funcionamiento<\/span><\/li><\/ul><h3><b>3.3 Compatibilidad del equipo<\/b><\/h3><p><span style=\"font-weight: 400;\">Usted es responsable de garantizar que sus dispositivos y sistemas cumplen los requisitos t\u00e9cnicos m\u00ednimos para la compatibilidad con el Servicio. Los requisitos est\u00e1n disponibles en<\/span><span style=\"font-weight: 400;\"><br\/><\/span><a href=\"https:\/\/www.t-mobile.com\/support\/coverage\/t-mobile-network#frequencies\"> <span style=\"font-weight: 400;\">https:\/\/www.t-mobile.com\/support\/coverage\/t-mobile-network#frequencies<\/span><\/a><\/p><h2><b>4. Cuenta y uso<\/b><\/h2><h3><b>4.1 Responsabilidad de la cuenta<\/b><\/h3><p><span style=\"font-weight: 400;\">Usted es responsable de:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Toda la actividad que se produzca en su cuenta<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Mantener informaci\u00f3n de la cuenta precisa<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Notificarnos con prontitud cualquier uso no autorizado<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Mantener la confidencialidad de sus credenciales de acceso<\/span><\/li><\/ul><h3><b>4.2 Pol\u00edtica de uso aceptable<\/b><\/h3><p><span style=\"font-weight: 400;\">Usted acepta utilizar el Servicio de conformidad con todas las leyes y normativas aplicables. Usted no podr\u00e1: <\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Revender, compartir o redistribuir el Servicio<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Utilizar el Servicio con fines comerciales<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Participar en actividades ilegales, fraudulentas o perjudiciales<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Interferir en las operaciones de la red o en el servicio de otros usuarios<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Vulnerar derechos de propiedad intelectual<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Transmitir spam, virus o c\u00f3digo malicioso<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Exceder patrones de uso razonables que afecten al rendimiento de la red<\/span><\/li><\/ul><h3><b>4.3 Solo uso personal<\/b><\/h3><p><span style=\"font-weight: 400;\">El Servicio es solo para uso personal y no comercial. El uso empresarial o comercial requiere un acuerdo de servicio comercial independiente. <\/span><\/p><h2><b>5. Facturaci\u00f3n y pago<\/b><\/h2><h3><b>5.1 Suscripci\u00f3n mensual<\/b><\/h3><p><span style=\"font-weight: 400;\">El Servicio se factura mensualmente a 35 $. El pago del primer mes vence en el momento de la activaci\u00f3n. Si se elige una opci\u00f3n de prepago, el servicio se pagar\u00e1 por adelantado en el proceso de compra por 360 $. Ambas opciones incluyen un periodo de prueba de 10 d\u00edas que permite un reembolso completo.   <\/span><\/p><h3><b>5.2 M\u00e9todos de pago<\/b><\/h3><p><span style=\"font-weight: 400;\">Aceptamos pagos mediante:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tarjeta de cr\u00e9dito<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tarjeta de d\u00e9bito<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Otros m\u00e9todos disponibles<\/span><\/li><\/ul><h3><b>5.3 Facturaci\u00f3n recurrente<\/b><\/h3><p><span style=\"font-weight: 400;\">Al inscribirse en la facturaci\u00f3n recurrente, usted autoriza cargos mensuales autom\u00e1ticos en el m\u00e9todo de pago seleccionado. Puede cancelar la facturaci\u00f3n recurrente al menos 7 d\u00edas antes de su pr\u00f3xima fecha de facturaci\u00f3n. <\/span><\/p><h3><b>5.4 Pagos atrasados<\/b><\/h3><p><span style=\"font-weight: 400;\">Los pagos atrasados pueden dar lugar a:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Suspensi\u00f3n del Servicio<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Recargos por demora (si procede)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cancelaci\u00f3n de la cuenta<\/span><\/li><\/ul><h3><b>5.5 Sin reembolsos<\/b><\/h3><p><span style=\"font-weight: 400;\">Los pagos no son reembolsables, salvo que la ley lo exija o seg\u00fan se especifique en estos T\u00e9rminos.<\/span><\/p><h3><b>5.6 Pago autom\u00e1tico obligatorio<\/b><\/h3><p><span style=\"font-weight: 400;\">La inscripci\u00f3n en la facturaci\u00f3n recurrente autom\u00e1tica (pago autom\u00e1tico) es obligatoria para todas las suscripciones del servicio. Debe mantener un m\u00e9todo de pago v\u00e1lido registrado y autorizar cargos mensuales autom\u00e1ticos. Si la inscripci\u00f3n en el pago autom\u00e1tico caduca o falla, nos reservamos el derecho de suspender o cancelar su Servicio hasta que se restablezca el pago autom\u00e1tico. Puede actualizar su m\u00e9todo de pago, pero no puede darse de baja del pago autom\u00e1tico mientras mantenga el Servicio activo.   <\/span><\/p><h2><b>6. Limitaciones del servicio y exenciones de responsabilidad<\/b><\/h2><h3><b>6.1 Gesti\u00f3n de la red<\/b><\/h3><p><span style=\"font-weight: 400;\">Mission Telecom y\/o T-Mobile pueden aplicar pr\u00e1cticas de gesti\u00f3n de la red, incluidas, entre otras:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Priorizaci\u00f3n del tr\u00e1fico durante la congesti\u00f3n<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Limitaci\u00f3n de velocidad tras alcanzar umbrales de datos<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Bloqueo o filtrado de puertos<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tratamiento espec\u00edfico por protocolo<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">No tenemos control sobre estas pr\u00e1cticas y no podemos garantizar un rendimiento espec\u00edfico de la red.<\/span><\/p><h3><b>6.2 Interrupciones del servicio<\/b><\/h3><p><span style=\"font-weight: 400;\">El Servicio puede interrumpirse, suspenderse o cancelarse debido a:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Mantenimiento de la red (programado o de emergencia)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fallo del equipo<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cortes de suministro el\u00e9ctrico<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Desastres naturales<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Normativas gubernamentales<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Decisiones de Mission Telecom o T-Mobile<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Otras circunstancias fuera de nuestro control<\/span><\/li><\/ul><p><b>NO SOMOS RESPONSABLES DE NINGUNA INTERRUPCI\u00d3N DEL SERVICIO, CA\u00cdDA DEL SERVICIO O PROBLEMAS DE RENDIMIENTO.<\/b><\/p><h3><b>6.3 Servicios de terceros<\/b><\/h3><p><span style=\"font-weight: 400;\">No somos responsables de sitios web, aplicaciones o contenidos de terceros a los que se acceda a trav\u00e9s del Servicio. El uso de dichos servicios se realiza bajo su propia responsabilidad. <\/span><\/p><h2><b>7. Privacidad y seguridad<\/b><\/h2><h3><b>7.1 Recopilaci\u00f3n de datos<\/b><\/h3><p><span style=\"font-weight: 400;\">Recopilamos y utilizamos informaci\u00f3n seg\u00fan se describe en nuestra Pol\u00edtica de privacidad, disponible en<\/span><a href=\"https:\/\/www.apollonet.org\/es\/politica-de-privacidad\/\"> <span style=\"font-weight: 400;\">https:\/\/www.apollonet.org\/privacy-policy<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p><h3><b>7.2 Seguridad de la red<\/b><\/h3><p><span style=\"font-weight: 400;\">Aunque aplicamos medidas de seguridad razonables, ning\u00fan servicio de internet es completamente seguro. Usted es responsable de: <\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Proteger sus dispositivos y su red<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Utilizar cortafuegos y software antivirus<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Proteger sus contrase\u00f1as<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Hacer copias de seguridad de sus datos<\/span><\/li><\/ul><h3><b>7.3 Supervisi\u00f3n<\/b><\/h3><p><span style=\"font-weight: 400;\">Podemos supervisar el uso de la red para:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Garantizar el cumplimiento de estos T\u00e9rminos<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Proteger la integridad de la red<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cumplir requisitos legales<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Mejorar la calidad del servicio<\/span><\/li><\/ul><h2><b>8. Exenci\u00f3n de garant\u00edas<\/b><\/h2><p><b>EL SERVICIO SE PRESTA \u201cTAL CUAL\u201d Y \u201cSEG\u00daN DISPONIBILIDAD\u201d, SIN GARANT\u00cdAS DE NING\u00daN TIPO, EXPRESAS O IMPL\u00cdCITAS, INCLUIDAS, ENTRE OTRAS:<\/b><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">COMERCIABILIDAD<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">IDONEIDAD PARA UN FIN DETERMINADO<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">NO INFRACCI\u00d3N<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">EXACTITUD O FIABILIDAD<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">SERVICIO ININTERRUMPIDO O SIN ERRORES<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Algunas jurisdicciones no permiten exenciones de garant\u00eda, por lo que estas limitaciones pueden no aplicarse en su caso.<\/span><\/p><h2><b>9. Resoluci\u00f3n de disputas<\/b><\/h2><h3><b>12.1 Resoluci\u00f3n informal<\/b><\/h3><p><span style=\"font-weight: 400;\">Antes de iniciar procedimientos formales, p\u00f3ngase en contacto con el servicio de atenci\u00f3n al cliente para resolver las disputas de manera informal.<\/span><\/p><h3><b>12.2 Legislaci\u00f3n aplicable<\/b><\/h3><p><span style=\"font-weight: 400;\">Estos T\u00e9rminos se rigen por las leyes de Carolina del Norte, sin tener en cuenta los principios sobre conflicto de leyes.<\/span><\/p><h3><b>12.3 Plazo de prescripci\u00f3n<\/b><\/h3><p><span style=\"font-weight: 400;\">Cualquier reclamaci\u00f3n debe presentarse en el plazo de un (1) a\u00f1o desde que surja o quedar\u00e1 definitivamente excluida.<\/span><\/p><h2><b>13.
