Apollo Net LLC Terms of Service

These Terms of Service (“Terms” or “Agreement”) constitute a legally binding agreement between Kramden Institute (“Kramden Institute,” “we,” “us,” or “our”) and you (“Customer,” “you,” or “your”), governing your use of wireless broadband internet services. The Services are delivered by Apollo Net LLC on behalf of Kramden Institute. By subscribing to, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Definitions

“Service” refers to the wireless broadband internet service provided by Apollo Net LLC, including all associated features, functionalities, and support services.

“Equipment” refers to any modems, routers, or other hardware devices provided by Apollo Net LLC for use with the Service.

“Network Operator” means T-Mobile US Inc., its subsidiaries, and affiliates whose network infrastructure is used to deliver the Service.

“MVNO” or “Mission Telecom” means Mission Telecom, the Mobile Virtual Network Operator that provides wholesale service to Kramden Institute via Apollo Net LLC through its agreement with T-Mobile.

“Subscription” refers to your monthly service plan with Apollo Net LLC.

“Effective Date” means the date you first subscribe to use the Service.

2. Service Description

2.1 Service Offering

This agreement is between Customer and Kramden Institute for the provision of wireless broadband internet service. Kramden Institute delivers this Service through Apollo Net LLC in partnership with Mission Telecom, utilizing T-Mobile’s network infrastructure. The Service is offered on a month-to-month basis at $35 per month or at $30 per month if prepaid for the year.

2.2 Service Availability

The service is subject to availability in your area as well as any possible technical limitations. Service availability, quality, speed, and reliability may vary based on:

  • Your location and distance from network towers
  • Network capacity and congestion
  • Weather conditions
  • Equipment functionality
  • Building materials and structural interference
  • Maintenance activities
  • Other factors beyond our control

2.3 No Guarantee of Service

APOLLO NET LLC DOES NOT OWN, OPERATE, OR CONTROL THE UNDERLYING NETWORK INFRASTRUCTURE. WE ARE A RESELLER OF SERVICES PROVIDED BY MISSION TELECOM WHO IN TURN OBTAINS SERVICE FROM T-MOBILE. AS SUCH, WE CANNOT AND DO NOT GUARANTEE:

  • Uninterrupted or error-free Service
  • Specific speeds or bandwidth
  • Availability in all locations
  • Compatibility with all devices or applications

3. Equipment

3.1 Equipment Provision

Apollo Net LLC will provide necessary equipment at no charge; this equipment may be new, used or refurbished. Upon receipt, the Equipment remains the property of Apollo Net LLC until the one year subscription anniversary at which point it becomes the property of the subscriber.

3.2 Equipment Restrictions

You agree to:

  • Not tamper with, modify, reverse-engineer, or alter the Equipment
  • Use only Apollo Net LLC-provided Equipment with the Service
  • Not use third-party equipment unless explicitly authorized in writing
  • Maintain the Equipment in good working condition

3.3 Equipment Compatibility

You are responsible for ensuring your devices and systems meet minimum technical requirements for Service compatibility. Requirements are available at

4. Account and Usage

4.1 Account Responsibility

You are responsible for:

  • All activity occurring under your account
  • Maintaining accurate account information
  • Promptly notifying us of unauthorized use
  • Keeping your login credentials confidential

4.2 Acceptable Use Policy

You agree to use the Service in compliance with all applicable laws and regulations. You may not:

  • Resell, share, or redistribute the Service
  • Use the Service for commercial purposes
  • Engage in illegal, fraudulent, or harmful activities
  • Interfere with network operations or other users’ service
  • Violate intellectual property rights
  • Transmit spam, viruses, or malicious code
  • Exceed reasonable usage patterns that impact network performance

4.3 Personal Use Only

The Service is for personal, non-commercial use only. Business or commercial use requires a separate commercial service agreement.

5. Billing and Payment

5.1 Monthly Subscription

The Service is billed monthly at $35. Your first month’s payment is due upon activation. If a prepaid option is chosen, the service will be prepaid at checkout for $360. Both options have a 10-day trial period which allows for a full refund.

5.2 Payment Methods

We accept payment via:

  • Credit card
  • Debit card
  • Other methods as available

5.3 Recurring Billing

By enrolling in recurring billing, you authorize automatic monthly charges to your selected payment method. You may cancel recurring billing at least 7 days before your next billing date.

5.4 Late Payments

Late payments may result in:

  • Service suspension
  • Late fees (if applicable)
  • Account termination

5.5 No Refunds

Payments are non-refundable except as required by law or as specified in these Terms.

5.6 Mandatory Autopay

Enrollment in automatic recurring billing (autopay) is required for all service subscriptions. You must maintain a valid payment method on file and authorize automatic monthly charges. If autopay enrollment lapses or fails, we reserve the right to suspend or terminate your Service until autopay is restored. You may update your payment method but cannot opt out of autopay while maintaining active Service.

6. Service Limitations and Disclaimers

6.1 Network Management

Mission Telecom and/or T-Mobile may implement network management practices including but not limited to:

  • Traffic prioritization during congestion
  • Speed throttling after data thresholds
  • Port blocking or filtering
  • Protocol-specific treatment

We have no control over these practices and cannot guarantee specific network performance.

6.2 Service Interruptions

The Service may be interrupted, suspended, or terminated due to:

  • Network maintenance (scheduled or emergency)
  • Equipment failure
  • Power outages
  • Natural disasters
  • Government regulations
  • Mission Telecom or T-Mobile decisions
  • Other circumstances beyond our control

WE ARE NOT LIABLE FOR ANY SERVICE INTERRUPTIONS, OUTAGES, OR PERFORMANCE ISSUES.

6.3 Third-Party Services

We are not responsible for third-party websites, applications, or content accessed through the Service. Your use of such services is at your own risk.

7. Privacy and Security

7.1 Data Collection

We collect and use information as described in our Privacy Policy, available at https://www.apollonet.org/privacy-policy.

7.2 Network Security

While we implement reasonable security measures, no internet service is completely secure. You are responsible for:

  • Securing your devices and network
  • Using firewalls and antivirus software
  • Protecting your passwords
  • Backing up your data

7.3 Monitoring

We may monitor network usage to:

  • Ensure compliance with these Terms
  • Protect network integrity
  • Comply with legal requirements
  • Improve service quality

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY
  • UNINTERRUPTED OR ERROR-FREE SERVICE

Some jurisdictions do not allow warranty disclaimers, so these limitations may not apply to you.

9. Limitation of Liability

9.1 No Consequential Damages

IN NO EVENT SHALL APOLLO NET LLC BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or performance issues
  • Third-party actions or content
  • Events beyond our reasonable control

9.2 Maximum Liability

Our total liability for any claim shall not exceed the amount you paid for the Service in the month preceding the incident.

9.3 Indemnification

You agree to indemnify and hold harmless Apollo Net LLC, its affiliates, Kramden Institute, Mission Telecom, and T-Mobile from any claims arising from:

  • Your use of the Service
  • Violation of these Terms
  • Infringement of third-party rights
  • Illegal or unauthorized activities

10. Changes to Service and Terms

10.1 Service Modifications

We reserve the right to:

  • Modify, suspend, or discontinue the Service
  • Change features or functionality
  • Update technical requirements
  • Change pricing costs and fees
  • Adjust network management practices

10.2 Terms Modifications

We may update these Terms by:

  • Posting revised Terms on our website
  • Notifying you via email or account dashboard
  • Providing notice with your billing statement

Continued use after changes constitutes acceptance of modified Terms.

11. Termination

11.1 Your Right to Cancel

You may cancel the Service at any time by:

  • Contacting customer support
  • Using your online account portal
  • Providing written notice

Cancellation is effective at the end of your current billing period.

11.2 Our Right to Terminate

We may suspend or terminate your Service for:

  • Non-payment
  • Terms violation
  • Fraudulent activity
  • Excessive network usage impacting other users
  • Legal requirements

11.3 Effect of Termination

Upon termination:

  • Service access ends immediately
  • Outstanding charges remain due
  • No refunds for partial months
  • You must cease using any Apollo Net LLC proprietary materials
  • You must return any Apollo Net equipment back to Apollo Net, i.e. specifically router equipment or face additional charges if within 12 months of service termination.

12. Dispute Resolution

12.1 Informal Resolution

Before initiating formal proceedings, contact customer support to resolve disputes informally.

12.2 Governing Law

These Terms are governed by the laws of North Carolina, without regard to conflict of law principles.

12.3 Statute of Limitations

Any claim must be brought within one (1) year after it arises or be permanently barred.

13. General Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement between you and Apollo Net LLC regarding the Service.

13.2 Severability

If any provision is deemed invalid, the remaining provisions continue in full effect.

13.3 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

13.4 Assignment

You may not assign these Terms without our written consent. We may assign our rights and obligations without restriction.

13.5 Force Majeure

Neither party is liable for delays or failures due to circumstances beyond reasonable control.

13.6 Notices

Notices to you may be sent via:

  • Email to your registered address
  • Your account dashboard
  • Postal mail to your billing address

13.7 Third-Party Beneficiaries

Mission Telecom and T-Mobile, along with their affiliates, are third-party beneficiaries of these Terms with the right to enforce provisions directly.
